5、 銀行保函與信用證相比有何不同?

(1) 付款責任：前者的開證行既可能承擔第一性付款責任，也可能是第二性付款責任。而后者承擔第一性付款責任。

(2) 付款依據(jù)：銀行保函支付的既可能是合同款，也可能是賠款或退款。而后者憑單據(jù)付款。

(3) 使用范圍：前者使用范圍大于信用證，后者僅限于正常履約的合同。
